Property & Financial Affairs Lasting Power of Attorney
A legal document that allows you to nominate in advance the person(s) who you would like to look after your financial affairs should you lose mental capacity, usually as a result of an accident, a stroke, or a disease such as Alzheimer's. Without one your sole and or joint assets can be frozen and no one will have access to your finances.
From: The British Bankers Association.
"What happens if the other joint account holder becomes mentally incapable?"
"If the other joint-account holder becomes mentally incapable, the bank or building society must get an order from the Court of Protection (in England and Wales), which protects the rights of mentally incapacitated people, before they can let you use the account."
Health & Welfare Lasting Power of Attorney
A legal document that directs who makes decisions relating to your health & welfare such as what care home you live in, the clothes you wear and the medicines administered. It also allows you to decide if someone has the right to refuse life sustaining treatment on your behalf should you be in a situation where you are unable to make your own decisions.
Powers of Attorney registration
We can draft your LPAs and register them with the Office of the Public Guardian. If you lose mental capacity your Attorney(s) will have to register your documents with the Office of the Public Guardian, a process which can take months. However, we can register your documents for you now saving you time and stress so the document(s) can be used immediately when they are required.
Further benefits of an English Family Trust
Inheritance Tax
Our wills and Trusts allow a married couple to pass £650,000* tax free and a single person to pass £325,000*
Probate fees "our Trusts save £000's"
The average probate fee charged by Banks, as cited recently in Money Mail and a Which Report, is £10,830. This works out at approximately of 4% of the value of the deceased's estate.
In the report, Barclays Bank was charging 4.5% of the first £100,000 of the estate and 3.5% of the next £400,000 and then 1.5% of the remainder.
In addition, they charged a further £400 for each beneficiary and £75 for each asset resulting in a massive £13,395 on an estate valued at £270,000.
Many other high street banks were also named as being hugely expensive.
By having one of our Family Trusts drafted, probate fees can be drastically reduced, and your estate, instead of taking months and in some cases years to distribute, can be dealt with immediately when the parent/former property owner dies.
Our Trusts provide much needed certainty to your family saving countless £000's in legal fees and making it as simple as possible for your beneficiaries to receive their inheritance.
Safe storage of your documents
Your documents can be stored in our vault which is fire proof, alarmed and has video surveillance.
